NEXT LEVEL GAME LOUNGE
ACCIDENT WAIVER AND RELEASE OF LIABILITY FORM
This Accident Waiver and Release of Liability Form ("Waiver") is executed by the undersigned participant ("Participant") in favor of Next Level Game Lounge, its owners, employees, volunteers, affiliates, agents, representatives, successors, and assigns (collectively, "Released Parties"). By signing this Waiver, Participant acknowledges and agrees to the following terms and conditions:
1. HEALTH ACKNOWLEDGEMENT
Participant certifies that they are physically fit, have sufficiently prepared or trained for participation in this activity, and have not been advised to refrain from participation by a qualified medical professional. Participant agrees that there are no health-related reasons or problems that prevent participation in axe throwing.
2. ASSUMPTION OF RISK
Participant understands that axe throwing is an inherently dangerous activity that involves risks of serious injury, permanent disability, or death. Risks include, but are not limited to, being struck by an axe, slipping, tripping, falling, equipment malfunction, and the actions of other participants. Participant voluntarily assumes full responsibility for any risks, injuries, or damages that may occur as a result of participating in this activity.
3. RELEASE AND WAIVER OF LIABILITY
Participant, on behalf of themselves, their heirs, assigns, personal representatives, and next of kin, hereby releases, waives, and discharges the Released Parties from any and all liability, claims, demands, actions, or causes of action, whether known or unknown, arising out of any injury, loss, or damage to person or property resulting from participation in axe throwing at Next Level Game Lounge.
4. INDEMNIFICATION
Participant agrees to indemnify, defend, and hold harmless the Released Parties from any claims, damages, costs, or expenses (including attorneys' fees) arising from Participant’s involvement in axe throwing activities, whether caused by negligence or otherwise.
5. MEDICAL TREATMENT
Participant consents to receive any medical treatment deemed necessary in the event of injury, accident, or illness while participating in axe throwing. Participant understands that they are solely responsible for any medical costs incurred.
6. SAFETY RULES AND INSTRUCTIONS
Participant agrees to abide by all safety rules and instructions provided by Next Level Game Lounge staff. Failure to comply with safety regulations may result in immediate removal from the premises without refund.
7. PHOTOGRAPHY AND MEDIA RELEASE
Participant grants Next Level Game Lounge the right to use photographs, videos, or other media taken during their participation for promotional and marketing purposes, without compensation.
8. LEGAL AGE AND CAPACITY
Participant affirms that they are at least 18 years of age or, if under 18, have a parent or legal guardian sign this Waiver on their behalf.
9. GOVERNING LAW
This Waiver shall be governed by the laws of the State of Ohio in which Next Level Game Lounge operates. Any disputes shall be resolved in the appropriate courts of the State of Ohio.
